WE ACCEPT BOOKINGS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS:

CONTRACT AND BOOKING

A 'Client' constitutes all persons named on the booking intending to travel, while a 'Product' refers to any Holiday package sold by Holiday Factory Philippines. The individual who transacts and signs the booking form (incorporating these terms and conditions), also known as the “Lead Passenger,” warrants full authority to do so on behalf of all listed persons and confirms their awareness and understanding of the herein terms and conditions.

Holiday Factory Philippines operates solely as a tour operator, offering travel products and services created on behalf of suppliers (airlines, hotels, service providers, etc.). All suppliers are independent entities and are not owned, managed, or operated by Holiday Factory Philippines.

The purchase of any travel services offered by Holiday Factory Philippines establishes a contract between the client and the company. This contract, encompassing all arising matters, is governed by and construed in accordance with the laws of the Republic of the Philippines. No employees or representatives of Holiday Factory Philippines possess the right to alter, vary, or waive any of these terms and conditions, nor undertake any liability on behalf of Holiday Factory Philippines, unless authorized in writing and signed by the CEO of Holiday Factory Philippines.

PRODUCT INFORMATION

Each product offered has its own validity and may not be valid during peak days, special/regular/public holidays including holidays in the destination, fairs, conventions, and embargo/block-off dates. Clients are advised to verify the validity for each deal.

All holiday package inclusions are published by Holiday Factory Philippines in good faith, and the company will make every effort to operate all products as described. Holiday Factory Philippines reserves the right to modify any of the facilities and services outlined in its website and publications, and to substitute alternative arrangements of comparable monetary value without compensation. The company accepts no liability for any changes made.

PAYMENT AND PRICING POLICY

Rates published by Holiday Factory Philippines are for one (1) adult, with a minimum number of two (2) adults required to purchase; a single supplement fee will apply for solo travelers. All holiday vouchers are valid for a limited period only and have specific validity periods. The client's reservation request will only be honored upon receipt of the required full payment due at the time of booking via the available payment channels. Every effort will be made to confirm the request; however, please note that travel arrangements are not confirmed until the client receives written confirmation that the services have been booked.

Holiday Factory Philippines reserves the right to make any necessary changes before a booking is confirmed and have the right to amend the price of the holiday package purchased due to any circumstances outside the control of Holiday Factory Philippines such as but not limited to changes relating to governmental action, increases in transportation costs (including scheduled airfares and the cost of fuel) changes in any dues, taxes or fees chargeable for services (including landing taxes or embarkation / disembarkation fees at airports), increases in admission fees and hotel rate adjustments / availability.

Holiday Factory Philippines reserves the right to adjust pricing for any additional fees that may have been incurred for reasons not listed above.

PRODUCT EXCLUSIONS

The price of any holiday package booked includes only the items specified. It does not cover items of a personal nature, including, but not limited to, personal insurance, transport to the outbound airport unless specified, refreshments, telephone calls, laundry, gifts, meals and beverages, optional excursions, passport and visa fees, porterage, gratuities, or taxes, unless otherwise specified. These items are the responsibility of the client.

E-GIFT VOUCHERS

Gift Vouchers can be used towards any holiday deals, and each voucher remains valid for 12 months from the purchase date. A single Gift Voucher can only be utilized once to create a single booking. Gift Vouchers are non-refundable, non-redeemable for cash, and cannot be used to purchase another gift voucher.

RESELLING OF HOLIDAY PACKAGES

Holiday Factory Philippines operates with direct sales to end users/clients, strictly prohibiting the resale of its packages. In the event of third-party sales, all bookings will be promptly canceled, and refunds will incur a penalty charge of at least 15% or PHP 5,000 per person, whichever is higher, as determined by the company.

SENIOR CITIZEN/PWD DISCOUNT

Persons with Disabilities/Persons with Reduced Mobility (PWD/PRM) and Senior Citizens (aged 60 and above) of the Republic of the Philippines are not entitled to the mandatory 20% discount and VAT exemption since the holiday package rates are promotional and already discounted. Double discounts are prohibited in accordance with the Rights of Persons with Disabilities Act and/or Senior Citizen Act.

YOUNG TRAVELERS

Minors under the age of 18 at the time of departure must be declared upon reservation and accompanied by an adult (parent or guardian with financial support) throughout the trip.

Holiday Factory Philippines may offer discounts to young travellers. To qualify, a birth certificate is required. The age for discount eligibility varies by destination and must be met at the start of services based on the chosen travel package.

INFANTS

Infants (below 2 years old) will incur a minimal handling fee based on the package selected and will be on one lap infant per adult basis. Infants less than sixteen (16) days old are not permitted to travel.

LATE FEES

Following the purchase of holiday vouchers, the lead passenger must submit their preferred travel dates within the specified period of each deal upon purchasing the voucher to avoid a late fee of PHP 500 per person. This fee, along with any applicable rate differences, will be charged once Holiday Factory Philippines receives the reservation request.

For partially paid bookings, the remaining balance must be settled by a specified due date. Failure to do so will result in a late fee of at least PHP 1,000.

AIRLINE

All airlines have distinct rules and policies concerning schedule adjustments. Due to each airline's operational requirements, they frequently modify the flights they are presently operating. These changes may be forecasts of future travel needs or immediate adjustments.

Holiday Factory Philippines will not be responsible if an airline cancels, reschedules, or delays a flight for any reason. The company will try to assist in making new arrangements if the client has not yet checked in with the airline for the first flight segment.

Airlines will directly inform travelers of any schedule changes via phone call or text; Holiday Factory Philippines does not receive notifications of flight changes. It is advisable for travelers to contact the airline to confirm the flight within 72 hours of departure. In case of any flight changes, Holiday Factory Philippines should be promptly notified bythe client via email, chat, or call. Travelers should regularly monitor emails or keep phone lines open for updates on flight schedules and respond promptly.

FUEL SURCHARGE

If an airline increases the cost of the flight ticket by imposing an additional fuel surcharge, Holiday Factory Philippines reserves the right to request the fuel surcharge amount from the client. The client will pay the fuel surcharge amount only if the surcharge is announced after the holiday package has been purchased.

BAGGAGE ALLOWANCE

Holiday packages offered by Holiday Factory Philippines may or may not include check-in baggage allowance. Should the client decide to purchase additional baggage later on, the client must inform Holiday Factory Philippines at least seven (7) days prior to departure subject to additional charge on top of the baggage fee. Otherwise, adding baggage allowance will be arranged by the client upon check-in.

Clients are allowed to each bring onboard two (2) pieces of bag as part of hand-carry with the total weight of both items not exceeding 7kg.

One (1) piece of cabin bag must not exceed 56cm x 36cm x 23cm including the handles, wheels and side pockets. This bag must be able to fit in the overhead compartment in the aircraW cabin.

Clients may also carry one (1) piece of laptop bag, handbag, backpack or any other small bag which must not exceed 40cm x 30cm x 10cm. This item must be able to fit under the seat in front of you.

TRANSFERS

Free Airport and Tour Transfer Services operate on a Seat-In-Coach basis, with specified times and locations for pick-up/drop-off strictly adhered to. Holiday Factory Philippines will not be held liable for missed services if clients fail to comply with the specified schedule/meeting point. If the airline reschedules or delays a flight, resulting in arrival at the destination beyond the allocated time for transfer, no free service transfers will be arranged, as flight changes by the airline partner are beyond our control. No refund will be provided for unused transport services.

HOTEL

Holiday Factory Philippines endeavours to its best abilities to honour the original hotel partner as per the client's booking. However, hotel rooms are always subject to availability. Therefore, if necessary, Holiday Factory Philippines reserves the right to substitute alternative hotels of equivalent or similar class, at any given time. No refunds will be provided for hotel changes, and full cancellation penalties may apply. Additionally, hotel upgrades may be subject to additional charges.

Security deposits, commonly known as incidental charges, may be collected by the hotel upon check-in. Hotel policies dictate that the standard check-in time is typically between 2pm and 3pm, and standard check-out time is between 11am and 12pm. However, these times may vary worldwide. Holiday Factory Philippines cannot control or guarantee check-in times.

MEALS

All holiday packages offered by Holiday Factory Philippines include daily breakfasts, while optional excursions may include either lunch or dinner, depending on the itinerary. Infants and children sharing a bed with parents are not entitled to breakfast. Parents of minors should purchase it separately at the hotel establishment.

TRAVEL INSURANCE

The insurance certificate is from Standard Insurance Co, one of the leading insurance companies in the Philippines and covers Personal Accident, Emergency Medical Treatment, Emergency Assistance Services, Inconvenience Travel Benefits and for International Packages, Personal Liability is included.

At Holiday Factory Philippines, keeping clients safe and well while on holiday is the number one priority. Therefore, Holiday Factory Philippines provides complimentary travel insurance to all clients under the age of 60.

Please note that individuals over 60 years of age are subject to additional surcharges as follows:

The products offered by Holiday Factory Philippines do not include any adventure and high-risk activities. It is strongly recommended that all customers avoid activities that might jeopardize their health and safety. Holiday Factory Philippines does not hold any responsibility for any injuries and damage caused to the customer from the time of booking for the full duration of the product. Holiday Factory Philippines accepts no liability on the client's behalf where it provided a product of a reasonable standard.

Holiday Factory Philippines reserves the right to change the insurance provider at any given point in time without any changes in the coverage offered.

EXCURSIONS

Sightseeing tours are not included in our packages unless specified. You have the flexibility to pick and choose which tours you would like to join. You will receive a brochure once all services has been booked to plan ahead and can book tours directly with our representatives when at the destination. The tours are at discounted prices, for all our valuable customers. Our representatives are there to enhance your local experience with every detail.

TAXES AND FEES

Holiday package rates are inclusive of value-added tax and service fees of Holiday Factory Philippines. However, they do not include government fees such as Philippine travel tax for international packages, international and domestic terminal fees set forth on selected airports and on some airlines, environmental fees, city/tourism taxes, and other government fees implemented on select destinations in the Philippines and abroad. The client is responsible for paying for such charges/fees.

Fees associated with tours, including mandatory tipping fees, souvenir fees, and other tour-related charges, are not included in all packages sold by Holiday Factory Philippines. The company is not responsible for any incurred fees during the tour that are not listed in the package inclusions. Holiday Factory Philippines ensures to provide information regarding necessary fees to be collected during the trip. Any additional fees or payments requested from clients during the trip are at the client’s discretion.

AMENDMENTS / REVISIONS

Please be advised that airlines do not permit name revisions on issued tickets. Holiday Factory Philippines is not liable for incorrect traveler information (Name, Title, Age, Date of Birth, and Passport Details) provided by the lead passenger. It is recommended to submit a passport copy when submitting preferred travel dates for the trip.

Confirmed reservations are non-transferable, and changes to another name and/or destination are not permitted. However, in the event that one or more parties are unable to travel due to death, injury, serious illness of the client, close relative or friend, redundancy, or jury service, it may be possible to transfer the booking to another suitable person or departure date, or a tour of similar standard and cost, subject to supplier rebooking fees and/or rate differences, provided that written notice is received by Holiday Factory Philippines with valid proof.

Any other amendments must be requested by the lead passenger and received by Holiday Factory Philippines at least seven (7) business days prior to departure, subject to approval. Necessary penalty charges will apply per person for any revisions made. The following charges will apply (in addition to the fees imposed by the Airline, Hotel, and/or other suppliers):

For packages involving visa processing, an additional amendment fee will be charged on top of the fee imposed by the embassy, depending on the destination purchased.

In the event that changes become necessary, Holiday Factory Philippines reserves the right to make changes at any time. Most of these changes are minor, and clients will be promptly informed accordingly.

CANCELLATIONS BY CLIENTS

Clients may cancel the holiday at any time by notifying Holiday Factory Philippines via email. The cancellation will be effective upon the date Holiday Factory Philippines receives and confirms the request.

Cash refunds will not be issued; instead, the amount will be converted into a "Credit Voucher/Travel Fund" for future purchases. This voucher will have an expiration date of at least two (2) years from the date of cancellation, and clients will receive an email notification confirming the issuance of the voucher.

The voucher amount will be calculated based on applicable deductions, including but not limited to cancellation charges. These charges will be levied depending on the nature of cancellation as outlined below:

1. Unredeemed vouchers

Unredeemed vouchers (travel dates not decided by the client and not confirmed by Holiday Factory Philippines) can be cancelled within the validity period, subject to a cancellation fee of PHP 1,000 per voucher.

Unredeemed vouchers cannot be utilized or refunded after the voucher's expiration date.

2. Confirmed bookings

Personal Discretion/Cause:

Confirmed bookings encompass all cases where services have been booked, regardless of whether travel documents were sent to the customer or not.

Cancellation (either partially or entirely) of booked services due to personal reasons or causes prior to departure is subject to approval and to the supplier’s (airline/hotel/transport company) cancellation policy. A cancellation fee is charged on top of the applicable penalties set by the supplier and 5% service charge, based on the calculation outlined in the table below:

The minimum cancellation fee for all confirmed bookings is Php2,500 per person (not applicable for infants). And cancellations made less than 15 days are non-refundable and non-rebookable.

Inevitable Circumstances:

For booking cancellations due to the following cases:

A. Death of the client upon presentation of a death certificate
B. Serious sickness of a client / immediate family member / travel companion / business partner upon presentation of a valid medical certificate
C. Witness summons, compulsory quarantine, or jury service of a client upon presentation of Subpoena or Legal Warrants
D. Serious damage to the client’s residence from fire or flood

The affected or accompanying client(s) may not be entitled to any refund from Holiday Factory Philippines but may be able to personally request from the Travel Insurance Company to process a claim subject to the terms and conditions of the insurance provider

Missed Flight/No Show:

If the client(s) fail either to:

A. Show up at the Airport Check-in Counters within the required period
B. Boards the aircraft at the appointed boarding time

The flight will be considered utilized, and the client(s) will not be entitled to a refund for the entire package, rebook, or apply for the creation of a Credit Voucher/Travel Fund.

SERVICE CANCELLATION

Holiday Factory Philippines reserves the right to decline any booking without further notice and explanation. Although checking the availability before purchasing the holiday voucher is not possible, we make every effort to provide the nearest available travel date from the original date requested without any additional charge. However, if the client is not amenable to the changes and wishes to cancel instead, the client can store the value in a Credit Voucher/Travel Fund for future use valid for two (2) years. Alternatively, they can request an immediate full refund after 6 months of unused Credit from the time the cancellation has been received.

FORCE MAJEURE & EXTRAORDINARY EVENTS

Holiday Factory Philippines reserves the right to cancel any confirmed booking in any circumstances, however, Holiday Factory Philippines will not cancel a guaranteed departure booking except in the unusual circumstances of force majeure, defined here as war, the threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, pandemic, epidemic, adverse weather conditions, flight cancellation or any other external circumstances beyond the control of Holiday Factory Philippines. Compensation is not available if Holiday Factory Philippines is forced to cancel or in any way change a tour due to force majeure.

In the event that Holiday Factory Philippines has already issued the travel documents (Flight & Hotel are already booked) and subsequent to that, the flights are canceled by the airline or the government for the reasons mentioned above, it is agreed that Holiday Factory Philippines can cancel the entire package. Subsequently, the client will be refunded up to 70% of the unused services, subject to the refund confirmation from the Airlines, Hotels, and other service providers. It's important to note that the cancellation process/refund process may take 12-24 months. However, if a supplier (Airlines, Hotel & others) declares bankruptcy or insolvency, then the amount of this service will not be refunded to the client.

The client will have the right to request with Holiday Factory Philippines, instead of a refund, to rebook the same (unused) services, free of charge, for a future travel date of their choosing. This rebooking will be subject to the condition that the force majeure event or the pandemic/epidemic/official advice/health emergency is no longer declared.

In the event of service cancellations during the client's travel due to the described circumstances, it is understood that Holiday Factory Philippines is not liable to refund or compensate the client. This occurrence is beyond the control of Holiday Factory. Regardless of the party initiating the cancellation during the events mentioned above, all refund processes will take 12 months.

SPECIAL ASSISTANCE (DISABLED, ELDERLY, PREGNANT, ETC)

Clients must report any disability requiring special attention to Holiday Factory Philippines at the time of reservation. While Holiday Factory Philippines strives to accommodate special needs, it cannot guarantee accommodation or be held responsible for any denial of services by air carriers, hotels, restaurants, or other suppliers.

Holiday Factory Philippines cannot provide individual assistance for walking, dining, transportation, or personal needs. It strongly advises travelers needing assistance to be accompanied by a qualified companion.

Some sightseeing stops/sites may not accommodate wheelchairs, and activities may involve extensive standing, sitting, or walking, including on uneven terrain. Holiday Factory Philippines is not liable for missed activities due to participants' inability to join the group.

HEALTH AND CONDUCT

Clients are expected to be physically fit to complete the itinerary of any chosen excursion. Clients with pre-existing medical conditions must declare them at the time of booking and provide a medical statement from a General Practitioner confirming their fitness to travel. Holiday Factory Philippines will not accept liability for failure to disclose such conditions.

CLIENT EXCLUSION AND LOCAL LAW

Clients agree to accept the authority and decisions of Holiday Factory Philippines and its supplier's employees and representatives whilst on tour. If in the opinion of such persons, the health or conduct of a client before or after the departure appears likely to endanger the safe, comfortable, or happy progress of the tour, the client may be excluded from all or part of the tour without prior notice or any liability on the part Holiday Factory Philippines. In the case of a client’s ill health, Holiday Factory Philippines may make such arrangements as it sees fit and recovers the costs thereof from the client. Clients agree to comply with the laws and regulations of the countries they travel to. Holiday Factory Philippines shall not be liable for any clients who commit illegal or unlawful acts whilst on tour.

TRAVEL DOCUMENTATION

Holiday Factory Philippines provides Travel Documents via email upon booking confirmation. Clients are responsible for possessing a valid passport, visa permits, medical certificates, and any other necessary documents required for travel.

Legal guardians, single parents, or either of the parents accompanying a young traveler must arrange the necessary travel documents independently. If not, young travelers must obtain a Travel Clearance on their own arrangement. Parents may contact their respective Social Welfare office to obtain this document.

Government employees holding high positions are required to obtain a "Travel Order" from their Head Office or the Office of the President before traveling abroad.

For expectant mothers or pregnant women, clients must advise of their pregnancy progress upon booking and at the time of check-in. Pregnancies of 24 weeks to below 34 weeks require a Fit-to-Travel clearance from the OBGYN, and expectant mothers need to fill out a special handling form upon check-in. Airlines do not accept the carriage of expectant mothers with a gestational age of 34 weeks and beyond.

Travelers with medical conditions, persons with disabilities, and persons with reduced mobility need to secure a fit-to-travel certificate from their attending physician or a PWD ID. It is also advisable for them to have an able person accompany them during travel.

Information about these matters is given in good faith by Holiday Factory Philippines but without liability. It is important that the client checks all details provided on the travel documentation are correct upon receipt. Holiday Factory Philippines cannot accept liability for any client refused entry onto any country due to failure of the client to carry correct documentation and clients will not be entitled to refund the entire package or rebook or apply for the creation of a Credit/Travel Fund.

PASSPORT AND VISAS

Clients traveling internationally are required to possess a passport, which must typically be valid for at least six (6) months from the date of travel. It is advisable to have a minimum of three blank pages in the passport, as many countries require such pages.

Many of our holiday international destinations offer "Visa Free" or "Visa on Arrival" options. For other destinations, we provide visas only if it is specifically stated in the package inclusions. Please note that obtaining visas and visa information is the sole responsibility of the traveler(s). However, we support your visa application by providing the necessary travel documents accepted by all visa centers. Clients must independently obtain all visas, entry documents, and meet health requirements as stipulated by the countries to be visited.

Holiday Factory Philippines does not provide specific visa and passport information or documentation. Clients are solely responsible for verifying and fulfilling all visa and passport requirements. Holiday Factory Philippines cannot be held liable if a client is refused entry into a country due to failure to obtain necessary visa or passport requirements. In such cases, clients will not be entitled to a refund, rebooking, or the creation of a Credit Voucher/Travel Fund.

VISA PROCESSING

WE ACCEPT BOOKINGS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS:

For holiday deals that include visa processing, Holiday Factory Philippines' main responsibility is to provide assistance. The company has no role in the assessment of a visa application, which is the sole prerogative of the Visa Section of whichever Embassy the visa is applied for.

Instant approval cannot be guaranteed, as visa processing depends on various factors including the client’s financial standing and credit history. Holiday Factory Philippines cannot be held liable for delays in visa processing or for the rejection of any visa applications. In the event of a visa denial, the holiday package remains nonrefundable but may be eligible for rescheduling or rebooking, subject to approval and the imposition of penalty fees such as rebooking charges, fare differences, and peak surcharges. Supplier terms and conditions will apply in such cases.

TRAVEL ADVICE AND VACCINATIONS

All clients should refer to the travel advice posted by the Local Government units of the destinations intended to visit. Vaccinations may be required for some, or all the places, and it is the client’s responsibility to ensure that all necessary vaccinations have been arranged prior to departure. Holiday Factory Philippines will not be held liable if a client is not able to depart due to lack of vaccination requirements and clients will not be entitled to refund the entire package or rebook or apply for the creation of a Credit Voucher/Travel Fund.

IMMIGRATION

The Bureau of Immigration has the right and absolute power to subject any client to question or interview upon exit from The Philippines and/or entry to the country of destination. Holiday Factory Philippines will not be held liable for any immigration decision to exclude any client to depart or enter a country due to any circumstances. Clients with deferred departure will not be entitled to refund the entire package or rebook or apply for the creation of a Credit Voucher/Travel Fund.

LIABILITY OF HOLIDAY FACTORY PHILIPPINES

With its Head Office based in the bustling city of Dubai, United Arab Emirates (UAE), Holiday Factory Philippines is an independent company licensed to market and distribute holiday packages and arrange for the holiday services offered on the website and social media.

Holiday Factory Philippines collaborates with third-party vendors and suppliers to offer a range of holiday packages and accommodations, covering services such as air transportation, lodging, and car rental. These partners operate as independent contractors and are not considered agents, employees, or joint ventures of Holiday Factory Philippines or its affiliates.

By utilizing the services provided, the client explicitly relinquishes any claims against Holiday Factory Philippines, its subsidiaries, or affiliates, as well as any officers, directors, agents, contractors, or employees associated with these entities. The client expressly agrees that neither the company nor any of its subsidiaries, affiliates, officers, directors, agents, contractors, or employees shall be held liable for

1. Any delays prior to departure or during travel to any hotels/resorts due to airline technical difficulties, strikes, weather conditions, or any other circumstances out of our control. Any expenses relating to these unscheduled extensions will be the client's own account.

2. Any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act of omission of, or any failure of performance of any kind by any other transportation company, vendor, or supplier.

3. Any inconvenience, loss of enjoyment, mental distress, or other similar matter.

4. Any cancellation or double booking of reservations or tickets beyond the reasonable control of Holiday Factory Philippines.

5. Any claim of any nature arising out of or in connection with air or other transportation, services, or other features performed or occurring in connection with any package component.

6. Any products or goods purchased while traveling are deemed as potentially fake or not authentic. We encourage our customers to exercise caution and to shop wisely.6. A

DATA PRIVACY

Holiday Factory Philippines is committed to protecting the client’s privacy. Information collected from individual clients is used solely for the purpose of conducting tours and shared only with authorized employees of Holiday Factory Philippines on a need-to-know basis. We constantly review our systems and data to ensure privacy.

Holiday Factory Philippines will not sell, share, or rent the client’s personal information to any third party or use the client’s e-mail address for unsolicited mails. Any emails sent by Holiday Factory Philippines will only be in connection with the provision of our services and products.

By making a booking, every client gives Holiday Factory Philippines the permission to use the photographs and videos made during travel (the photographs and videos could include every client) for promotional and commercial use.

COMPLAINTS

If the client has a complaint about any of the product arrangements, the lead passenger must raise the complaint immediately with a Holiday Factory Philippines employee or legal representative so that Holiday Factory Philippines can use its best endeavors to rectify the problem. Holiday Factory Philippines cannot rectify a problem it is unaware of. Failure to complain immediately will extinguish or at least reduce Holiday Factory Philippines’ liability to pay compensation. Although every effort will be made to resolve a complaint to the client’s satisfaction, it is specifically recorded that Holiday Factory Philippines in no way accepts liability for any claim.
